Terms of Service

These Terms of Service ("Terms") govern your access to and use of services provided by McCaman LLC ("we," "us," "our"), including seanmccaman.com, any related subdomains, and any SMS or messaging programs we operate (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

This website is read-only. seanmccaman.com publishes content for you to view. It does not accept user accounts, file uploads, comments, or any other user-submitted content. Forms, when present, are limited to opt-in flows for the SMS program described in §3 — no other data flows from you to us through this site.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of legal majority in your jurisdiction, you may use the Services only with involvement of a parent or legal guardian.

3. SMS / Messaging Program Terms

Summary: If you opt in, you'll receive occasional text messages from McCaman LLC. Message and data rates may apply. Reply STOP to cancel, HELP for help. Your mobile information is not shared with third parties for marketing.

3.1 Program description

We operate an SMS messaging program for operational and transactional notifications — for example, service alerts, appointment reminders, status updates for home-automation or utility services, and one-time authentication codes. The specific messages you receive depend on which opt-in you accepted.

3.2 Consent

You will only receive SMS messages from us after you affirmatively opt in — for example, by submitting a form, replying YES to a confirmation message, or similar verifiable action. Opt-in is never a condition of any purchase.

3.3 Frequency

Message frequency varies based on the program and your activity. You can expect messages to be occasional (typically not more than a few per week in most programs) rather than continuous.

3.4 Costs

We do not charge you to receive messages. However, message and data rates may apply based on your mobile carrier plan. Check with your carrier for details.

3.5 Opting out

You may opt out at any time by replying STOP to any message in the program. You will receive one confirmation message acknowledging the opt-out, after which you will not receive additional messages unless you opt in again.

3.7 Carriers and delivery

We rely on third-party telecommunications carriers to deliver messages. Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier, handset capabilities, and network conditions.

3.8 Supported carriers

The program is supported on major U.S. carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, and Boost Mobile. Wireless carriers are not liable for delayed or undelivered messages.

3.9 Privacy

Your use of the SMS program is subject to our Privacy Policy. We do not share your mobile phone number or the content of SMS messages with third parties or affiliates for marketing or promotional purposes.

4. AI-assisted tutoring features

Summary: Course pages under /acctg5150/ embed an AI tutor that helps students work through interactive exercises. AI output can be wrong — verify before relying on it. On supported Chrome browsers the tutor runs entirely on your device and no message contents are sent to us; on other browsers it builds a prompt you choose to copy into a third-party AI service.

4.1 AI-generated content may be incorrect

The AI tutor can produce wrong, incomplete, or out-of-date answers, including syntactically invalid code or factually mistaken explanations. You must verify AI output before relying on it for coursework, decisions, or anything else. The tutor is provided as an educational aid, not an authority — judging AI output is one of the skills the course intentionally teaches.

4.2 Educational purpose only

The tutor is provided for instructional support inside the embedding course pages. It is not professional accounting, legal, tax, financial, career, or any other professional advice. It does not represent the University of Utah, the David Eccles School of Business, or any third-party AI provider.

Pages that use Chrome's built-in language model participate in a Google Chrome Origin Trial. Google may collect telemetry about your use of the Chrome Prompt API consistent with Google's own policies. This is independent of McCaman LLC.

4.5 No commitment of availability

AI features may be disabled, modified, or removed at any time without notice, including if the Chrome Origin Trial token expires, if the Prompt API changes, or for any other reason.

4.6 Disclaimers and liability limits apply

The "as is" warranty disclaimer in §6 and the liability limit in §7 apply in full to the AI tutor features and to any output, action, or recommendation produced by them.

5. Intellectual property

All content on the Services — including text, graphics, logos, and software — is owned by McCaman LLC or its licensors and is protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works without prior written consent, except as permitted for personal, non-commercial viewing of the Services.

6. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.

7. Limitation of liability

To the maximum extent permitted by law, McCaman LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our total cumulative liability for any claim arising from or relating to the Services shall not exceed one hundred U.S. dollars (USD $100).

8. Indemnification

You agree to indemnify and hold harmless McCaman LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Services.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violations of these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination — including intellectual-property rights, disclaimers, and limits of liability — will survive.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Effective date" at the top of this page. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction there.
